“Piano Planet” shall mean collectively “Piano Planet services” and all its related past, present, and/or future, website(s), app(s), mobile/web/desktop software, modules, game(s), media, user accounts, user data, communities, and spin-offs. Piano Planet and it’s assets, IP, data and all other Piano Planet services are wholly owned and made available by EmpowerED Group Inc. (“EmpowerED”). EmpowerED is sometimes also referred to herein as “we,” “us,” or “our.”
Piano Planet’s Privacy Policy (“Privacy Policy”), the separate End User Licensing Agreements (“EULA”), the Piano Planet TOS, and any rules or instructions regarding a particular activity, poll, or other offer expressly modifying these Privacy Policy, EULA, and/or TOS, constitute the “Piano Planet Terms.”
Piano Planet respects your privacy rights and recognizes the importance of protecting the information collected about you. We have adopted this Privacy Policy to explain how we collect, use and store your personal and non-personal information as set forth in the General Data Protection Directive (“GDPR”) and Children’s Online Privacy Protection Act (“COPPA”).
The data controller pursuant to the GDPR and COPPA in respect of any Personal Information that you submit to us via the Piano Planet Services (or otherwise) is EmpowerED Group Inc. as defined above. The Personal Information you submit to us via the Piano Planet Services (or otherwise) will be processed by us or by data processors appointed by us to undertake processing on our behalf.

We will require you to verify your identity before releasing any information to you.
“Personal Information” is information that we have collected from you that identifies you, or which, in conjunction with other information that is in our possession, or is likely to come into our possession, may be used by us to identify you.
“Non-Personal Information”, is information that we have collected from you which cannot be used by us to identify you.
We will keep your Personal Information accurate, complete and up-to-date with the information that you provide to us. If you request access to your Personal Information, we will inform you of the existence, use and disclosure of your Personal Information as allowed by law, and provide you access to that information. We will always ask for your consent before using your Personal Information for a purpose other than those described in this Privacy Policy.
In certain limited circumstances, we may be required by law to share information with third parties or public authorities, including to meet national security or law enforcement requirements.
Personal Information may be shared with third parties to prevent, investigate, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our TOS or any other agreement related to the Piano Planet Services, or as otherwise required by law.
Personal Information may also be shared with a company that acquires our business, whether through merger, acquisition, bankruptcy, dissolution, reorganization, or other similar transaction or proceeding. If this happens, we will post a notice in the Piano Planet Services or notify you by email.
Piano Planet and any affiliates that receive your Personal Information, are responsible for all onward transfers of Personal Information to third parties in accordance with the EU-US Privacy Shield Principles, the U.S.-Swiss Safe Harbor Framework, and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).
Piano Planet will always ask for your consent before sharing your Personal Information with third parties for purposes other than those described in this Privacy Policy.
You are in charge of your information and have the right to request deletion of your Personal Information. You can request partial or full deletion by contacting us at privacy@pianoplanet.app.
If you don’t request deletion manually, we will remove your Personal Information after a reasonable amount of time of inactivity.
In the event we collect Personal Information from a Minor child (defined below) we will take reasonable steps to delete the Personal Information as soon as it is no longer needed. If you wish to request that we delete your or your Minor child’s Personal Information, please contact us by email at privacy@pianoplanet.app.
Additionally, we will continue to store and use anonymous or anonymized information, such as your access to and use of the Piano Planet Services, without identifiers, in order to improve the Piano Planet Services.
We do not and will never sell your Personal Information to other companies for the marketing of their own products or services.
We follow industry standards on information security management to safeguard sensitive information, such as financial information and any other Personal Information entrusted to us. Our information security systems include technical and organizational measures that apply to people, processes and information technology systems on a risk management basis.
Please note, however, that no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee the absolute security of your Personal Information.
If you are located in the EEA, you have certain rights under European law with respect to your Personal Information, including the right to request access to, correct, amend, delete, port to another service provider, or object to certain uses of your Personal Information. Additionally, if you are located in the EEA, we note that we are generally processing your information in order to fulfill contracts we might have with you (for example to provide you with the Piano Planet Services pursuant to our Terms of Service), or otherwise to pursue our legitimate business interests, unless we are required by law to obtain your consent for a particular processing operation. In particular we process your Personal Information to pursue the legitimate interests of improving the Piano Planet Services so it will function better for you and other users, improving our websites or other services, to test out features or additional services, and to provide support services or to answer questions. When we process Personal Information to pursue these legitimate interests, we do so where we believe the nature of the processing, the information being processed, and the technical and organisational measures employed to protect that information can help mitigate the risks to the user’s Personal Information.
You retain all rights to your Personal Information or if you are a Parent with a Minor child using our service, you retain all rights to your Minor child’s Personal Information and can access it anytime. In addition, we take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Information. It’s important to remember that if you delete or limit the use of your Personal Information, the Piano Planet Services may not function properly.
Please note that, as stated above, we retain certain Personal Information when you uninstall the Piano Planet application.

Piano Planet Services are intended for users of all ages. Our sites and applications offer a variety of activities that may collect information from Minor children. Below we summarize potential instances of collection and outline how and when we will provide parental notice and/or seek parental consent. In any instance that we collect Personal Information from a Minor child, we will retain that information only so long as reasonably necessary to fulfill the activity request or allow the Minor child to continue to participate in the activity, and ensure the security of our users and our services, or as required by law. In the event we discover we have collected Personal Information from a Minor child in a manner inconsistent with COPPA’s or GDPR-K requirements, we will either delete the information or immediately seek the parent’s consent for that collection.
Because COPPA and GDPR-K define different ages for minor children, for the purpose of clarity we define a minor as children who are under 13 years of age within the USA and under 16 years of age outside the USA (“Minor(s)”).
Certain activities on our sites and applications allow Minors to create or manipulate content and save it on Piano Planet Services. Some of these activities do not require Minors to provide any Personal Information and therefore may not result in notice to the parent or require parental consent. If an activity potentially allows a Minor to insert Personal Information in their created content, we will either pre-screen the submission to delete any Personal Information, or we will seek verifiable parental consent by email for the collection. Examples of created content that may include Personal Information are stories or other open-text fields, and drawings that allow text or free-hand entry of information. If, in addition to collecting content that includes Personal Information, and Piano Planet also plans to post the content publicly or share it with a third party for the third party’s own use, then we will obtain a higher level of parental consent.
Certain activities that are directed to Minors allow users to communicate directly with other users by means of a chat system. In most cases, these chat systems employ community rules and manual moderation that are intended to prevent the communication of both Personal Information and vulgar language. Our live moderators may encourage other users to flag inappropriate communications. We strongly encourage all Minor children who use these interactive features through our sites or applications or third party applications to never provide Personal Information about themselves or any third party, and certainly never to attempt to circumvent our rules and/or moderation. WE ALSO STRONGLY RECOMMEND THAT PARENTS CAREFULLY SUPERVISE THEIR MINOR CHILDREN WHEN THEIR MINOR CHILDREN PARTICIPATE IN ONLINE ACTIVITIES. We take all these steps to try to keep your Minor child safe while using our Piano Planet Services, but there is no substitute for your close watch over what your Minor children do, say, and who they talk to.
If you are a parent of a Minor child who uses the Piano Planet Services, you have the legal right under GDPR-K and COPPA to order us to delete or redact their Personal Information. You can request deletion of your Personal Information by emailing us at privacy@pianoplanet.app.
If you are living in the USA and under 13 years old OR outside the USA and under 16 years old, then you are considered a Minor child by GDPR and COPPA law and this section will help you.
If you’re a Minor using Piano Planet, it’s important to keep yourself safe, so please follow this checklist:
Never share any Personal Information with Piano Planet without getting permission from your parent or guardian first, and if you’re sharing something new make sure you have permission first.
Never publicly share any of your: Last name, Street, City, Birthday, Picture/video of your face, any information that could be used to personally identify you, and never share information about your friends so that you can keep them safe also.
Don’t talk to anyone without your parent or guardian’s permission, and if someone messages you, show your parent or guardian first and ask them what to do.

Piano Planet collects information when you use our website(s), create a Piano Planet Account, general use of Piano Planet Services and other ways which will be explained further below.

If you participate in any competitions, the relevant information such as your results or ranking may be displayed with your nickname on the Website and other related Piano Planet Services.
When Piano Planet, or any element or module thereof, is updated or “patched,” our patch routine may check your computer to see that you have the most recent version of Piano Planet-specific files.
We use this information to fulfill our contractual obligations to you, to optimize usage, enhance your experience and to enforce our rights and the rights of other users in case of suspicion of fraud (see also Sec. 5.4 below).
The collection of the information set out in this Section 5.3 is mandatory as we cannot operate, optimize and enhance Piano Planet properly without collecting this information. If you do not agree with this data collection and storage we will need to deactivate your account and access to Piano Planet. For legal reasons this information will be stored as long as your account remains open and for the applicable statutes of limitations thereafter.
In addition to Sections 5.1 to 5.3, if we reasonably suspect that any of the Piano Planet Services or your Account is being or has been misused, including without limitation, by virtue of any:
